Among other things, SEC Regulation SHO imposes a "close out" requirement upon broker/dealers for securities in which a substantial number of failures to deliver have occurred at a registered clearing agency ("threshold securities"). It further requires each national securities exchange or association to determine which of its listed securities meet the criteria applicable to threshold securities, and to publish a list of all such threshold securities on a daily basis. As a service to its clearing members and other market participants, OCC collects and combines each such list into a single, listing of threshold security information, but makes no determination of whether a security is a "threshold security" for purposes of Regulation SHO.
